Smidge® User Generated Content Policy

Authorization and Release 

Organic 3, Inc., doing business as “Smidge” and “Rosita” (“O3”) thanks you for submitting your stories, comments, photos, recordings, and other content created by you (“Materials”) regarding our products and services. By submitting your Materials, you authorize O3 to make certain uses of the Content, and you make certain promises (“Agreement”) as follows: 

You are the author of the Materials. You have the right to provide them to O3 and to authorize the use below. Nothing in the Materials violate the rights of third parties. 

The statements you make about the products/services of O3 are your own truthful experience and opinion. 

You grant O3 the right to use the Materials in connection with its lawful business activities. This permission includes copyright (copying, adapting, displaying, and combining with other content), and to promote and endorse O3 products and services. It is worldwide, sublicensable, for all media now known or later developed, royalty-free, and in perpetuity. 

To the extent the Materials contain your face, likeness, profile, name, personal information, voice or other personal attributes, the license above includes a license under your right of privacy/right of publicity. If O3 uses your Materials (such as on social media, on its web site, in connection with promotional materials) it will not identify you with your last name (unless you expressly authorize such use) but will use a short-hand reference such as “Jane D., Los Angeles.” 

You are over the age of 18 years. You have not been promised any consideration in exchange for this Agreement. You waive any claim of moral rights and any right of attribution. 

This Agreement is governed by the laws of the State of Michigan. It is the entire agreement between the parties with respect to the Materials. It is binding upon the parties and their heirs, personal representatives, agents, successors, and assigns. You hereby release O3, its licensees, related business entities, owners, directors, officers, employees, and agents, from all claims relating to conduct within the scope of this Agreement.

Again, Organic 3 is grateful to you for sharing your Materials and for allowing us to use them to achieve our mission.
